In consideration of being permitted to participate in a FORE! & MORE mobile golf simulator experience, I acknowledge and agree to the following:
I understand that participation involves swinging a golf club at high speed within a defined activity area and carries inherent risks, including contact with a club, ball, simulator equipment, screen, enclosure or other participants/bystanders; slips, trips and falls; muscle strains and other orthopedic injuries; and property damage or bodily injury. I knowingly and voluntarily assume the inherent risks of participation.
TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, I RELEASE AND WAIVE ANY CLAIMS AGAINST TIMOTHY D. ARMSTRONG DBA FORE! & MORE, AND ITS EMPLOYEES, CONTRACTORS, EVENT STAFF, AGENTS AND REPRESENTATIVES, FOR PERSONAL INJURY, DEATH OR PROPERTY DAMAGE ARISING FROM OR RELATED TO MY PARTICIPATION IN A FORE! & MORE MOBILE GOLF SIMULATOR EXPERIENCE, INCLUDING CLAIMS CAUSED BY THE ORDINARY NEGLIGENCE OF FORE! & MORE OR ANY OTHER RELEASED PARTY.
I understand that this release is intended to apply to risks associated with participation in the golf simulator experience, including the activities and risks described in Section 1 above.
I agree to follow posted rules and all instructions of FORE! & MORE staff, including swing-area boundaries, spectator positioning and equipment handling. I understand that FORE! & MORE may stop or deny my participation for unsafe conduct.
I will not participate while impaired by alcohol, cannabis, illegal drugs, prescription medication or any other substance that may affect judgment, balance or coordination. FORE! & MORE may refuse or stop participation if, in its reasonable judgment, I appear impaired or unable to participate safely.
I represent that I am physically able to participate safely. I am responsible for deciding whether participation is appropriate for me in light of any medical condition, injury, limitation or other health concern.
In the event of an injury or medical emergency, I authorize FORE! & MORE staff to contact emergency medical services and to provide reasonable assistance until professional help arrives. I understand that FORE! & MORE staff are not medical professionals and do not provide medical treatment. I am responsible for any medical expenses incurred on my behalf.
Participants under 18 must have this form completed by a parent or legal guardian. The parent or legal guardian must provide their name, relationship to the participant, and signature below.
I confirm that I have read and understand this Participant Release & Waiver and that the information I have provided is accurate. By signing below, I acknowledge and agree to the terms stated above.
